Terms and Conditions

Please read and understand these terms and conditions carefully before using the Site. By using the Site or any part of it, you agree that you are agreeable to the terms and conditions contained herein and that you accept and agree to be bound by them.

We are Mahsa Specialist Hospital Sdn. Bhd( Company No: 1329975-W) having our registered address at Mahsa Specialist Hospital, Jalan SP 1/3, Bandar Saujana Putra, 42610 Jenjarom, Selangor the trading name of MSH ePharma and running the website of https://mshepharma.myshopify.com/.

MSH ePharma is a subsidiary company of Mahsa Specialist Hospital Sdn. Bhd (Company No: 1329975-W) having its business address at Mahsa Specialist Hospital, Jalan SP 1/3, Bandar Saujana Putra, 42610 Jenjarom, Selangor.

TERMS OF USE

Interpretation

  1. “Account” means the MSH ePharma Account that you need to register online in order to place an order on the Site.

  2. “Business Day” means a day (other than a Saturday, Sunday or gazetted public holiday in Selangor).

  3. “Customer” means any individual, firm, company or body who places an order with MSH ePharma.

  4. “Delivery Charges” means the additional cost that the Customer needs to pay and shall be calculated based on the weight of the order received and will be charged in addition where applicable. This charges cannot be paid by eCoupon, eVoucher, redemption of points and excluded from earning points.

  5. “Featured Product” means items or products highlight of the current month.

  6. “GST” means Goods and Services Tax.

  7. “MSH ePharma” means Mahsa Specialist Hospital Sdn. Bhd (Company No: 1329975-W).

  8. “Order” means the final order submitted by you on the Site to purchase Product with MSH ePharma.

  9. “Return Form” means return form that the Customer needs to submit for return/exchange and refund.

  10. “Order Confirmation” means acknowledgement email of the Customer’s Order.

  11. “Products” means any and all products offered for sale by MSH ePharma.

  12. “PDPA” means Personal Data Protection Act.

  13. “Site” means this https://mshepharma.myshopify.com/

  14.  “You” means Customer who places the order.

Construction

1. References to Clauses are to be construed as referring to the Clauses of this Terms and Conditions. It shall have the same effect as the provisions herein insofar as it does not affect the meaning and interpretation of this Terms and Conditions.

Headings and subheadings are inserted for ease of reference only and shall in no way affect the meaning and interpretation of the provisions to this Terms and Conditions.

Words importing the feminine gender shall include the masculine and neuter genders and vice versa.

Words importing the singular meaning where the context so admits include the plural meaning and vice versa.

Words denoting and obligation on a party to do any act, matter or thing includes an obligation to procure that it is done.

REGISTRATION AND ACCOUNT SECURITY

1. To register with https://mshepharma.myshopify.com/ in order to enjoy the services on the Site.

2. During registration, you represent and warrant that :

  1. If you are an individual, you must be over eighteen (18) years of age.

  2. If you are an individual of under eighteen (18) years of age, you may only use this Site with the consent of and under the supervision of your parent or legal guardian who shall be responsible for all your activities.

  3. If you are representing a company or other legal entity, you have the authority to represent and will be bind to these Terms and Conditions.

  4. All information you provide is accurate, complete, truthful and up to date.

3. After registration,

  1. You are responsible and accountable for all activities under your Account.

  2. To keep and safeguard your username and password.

  3. Keep your Account information up to date at all times.

  4. Not to use other user ID or account of another party without their permission.   

ONLINE ORDER

1. The full payment of the Order shall be paid by you upon receiving the total amount of the Order by securing credit or debit card or online payment whereby we then will proceed to process your Order.

2. Subject to availability, we reserve the right to restrict and/or refuse and/or cancel the number of Products available for sale to any Customer. Should any of the Products are not available and has been paid, we will provide a full refund to the Customer.

CANCELLATION

1. Should the Product is not available for any whatsoever reason, we reserve the right to cancel an Order. Any refund of payment shall be credited into credit or debit account subject to your financial institution used at that particular time of payment.

2. We shall not be liable with respect to any loss, damage, cost or expense that you or any person may incur as a result of any delay in your financial institution processing the said refund.

PRICE AND PRODUCT

1. At MSH ePharma, we use all reasonable endeavor to ensure prices displayed on the Site are accurate.  All product prices listed are in Ringgit Malaysia (RM).

2. Some promotions and prices in this Site do not always apply to our outlet, vice versa. Furthermore, prices may vary or change over time due to promotion and/or non-promotion period and are subject to change without prior notice. The prices charged and displayed on the Site only applicable on the day that the order is made.

3. In the event that the prices, details and sizes display on the Site is incorrect, such cases we reserve the right to refuse and/or cancel any Order at our sole discretion.

4. All pictures shown on the Site are for illustration purposes only. Actual Product such as size, dimension and color may vary due to product enhancement.

5. Prices of the Product excludes the cost of packaging and Delivery Charges, GST (if applicable), or any other tax which you shall be liable to pay in addition.

PAYMENT TERMS

1. Please be informed that we do not accept cash on delivery. Hence, you have the options for the payment be made by Visa, Mastercard, credit card, debit card and Online Banking on the Site.

2. For a secure online commerce transactions,MSH ePharma uses SenangPay Payment Gateway which allows online payment via credit cards, debit cards and e-banking.

4. Nonetheless, all Orders are subject to validation checks and authorization by the card issuer.

5. Similarly, you can pay all or part of the price of your order using store credit or a promotional voucher. This promotional voucher shall be entered at the check out page online only.

6. We reserve the right to amend and/or change and/or vary payment terms for any Order without prior notice to the Customer.

7. For inquiries and/or issues with regards to your payment card, kindly contact your card issuer accordingly.

ACCEPTANCE OF ORDER

1. Once the Order has been validated and the payment has been accepted, we will send an Order Confirmation to the email address you provided in your Account.

2. A contract is formed upon the Order (subject to the availability of the Product) together with payment made by you and we accept via Order Confirmation and process the Order and subjected to these Terms and Conditions. Otherwise, the Site and this Terms and Conditions is merely an invitation to treat.  

3. Completion of contract between the Customer and MSH ePharma will only be completed upon the Product is received by the Customer according to their order.
